Intellectual Property and Technology Alert: Optus TV Now decision: Copyright infringement risks for online content and the cloud - 30 Apr 2012

Telstra, the NRL and AFL have won a court appeal against Optus, reversing an earlier Federal Court decision in which Optus was allowed to continue operating its TV Now service, enabling users to select and schedule recordings of their favourite programs - including AFL and NRL matches, which Telstra had the exclusive rights to broadcast.

The original decision saw many in the industry calling for legislative intervention in order to stop what was seen as exploitation of a loophole in the law.

Senior associate Hayden Delaney from HopgoodGanim's Intellectual Property and Technology team discusses the appeal decision and its implications for cloud services on BRR Media.
