HG Alert: Modified Small Business Fair Dismissal Code Released - 21 Jul 2010

Responding to Fair Work Australia's criticisms about the reliability of the last version of the Small Business Fair Dismissal Code, the Federal Government issued a modified version of the Code on Monday 19 July 2010.

The Code has been amended to clarify that it only applies to employers of less than 15 full time equivalent employees. The role of the Checklist tool has been better explained, and new questions will ensure more details are recorded about the dismissal. Additional information about procedural fairness (the right to a support person) and the genuine redundancy exemption has also been included.
