Kim practices in all areas of banking and finance law, and specialises in corporate and business finance. He provides strategic and practical advice on a range of project documentation, including finance documents, charges and mortgages, and also advises parties receiving finance.

Kim has experience undertaking due diligence for a variety of lenders who provide commercial loans. He also advises clients on the impact of the Personal Property Securities Act 2009 on their businesses, including advising on strategies to effectively protect their interests and minimise risk by registering security interests under the PPS Register.

Kim holds qualifications in Laws (Honours) and Arts (Justice Studies) from Queensland University of Technology.

Areas of Practice

  • Acting for Capital Finance Australia Limited (CFAL) in establishing and restructuring cross-collateralised facilities for acquisition and constructing funding of large scale residential and industrial developments in Queensland by the Doyle Group, including assisting in the negotiation of intercreditor arrangements with the Australand Group.
  • Undertaking finance and property due diligence for the establishment of cross-collateralised facilities for the IMDM Group (including in relation to the group’s interest in a development site regulated by a complex regime established by the Breakwater Island Casino Amendment Act).
  • Acting for Capital Finance Australia in the establishment of cross-collateralised construction funding and corporate finance facilities for the SSI Group.
  • Acting for Capital Finance Australia in relation to numerous cross-collateralised acquisition and construction facilities involving a Gold Coast development group, comprising 25 companies and 50 trusts.
  • Acting for St.George Bank in the establishment of a number of cross-collateralised corporate finance facilities for a large pharmaceutical company.
  • Advising Bandanna Energy on its funding participation in the Wiggins Island Coal Export Terminal.
  • Undertaking drafting and transactional work for numerous commercial and agribusiness loan transactions secured over property in Queensland and New South Wales, including bills of sale and stock mortgages for the Bank of Western Australia.
  • Advising on construction funding for the French Quarter and Town Centre precincts within the Emerald lakes development located on the Gold Coast.
  • Preparing and negotiating facility documentation for the funding of student accommodation group, UniLodge.
  • Advising Ashe Morgan Winthrop on the establishment of finance and profit participation facilities for the developer of the Da Vinci Centre commercial and industrial complex in the Brisbane Airport, and the subsequent sell down.
  • Advising the FKP Group on negotiating facility and security documents for the Group’s property portfolio.
