As  a senior practitioner in HopgoodGanim Lawyers’ Commercial Property team, Kellie advises clients on a large range of legal issues associated with property law. 

Through her experience in property law, Kellie has prepared, reviewed, advised and negotiated a number of commercial and retail lease agreements and licence agreements, handled the sale and acquisition of commercial properties as well as advised on business structure and banking & finance matters.

Kellie holds a degree in law from the University of Notre Dame, and is admitted as a solicitor in the state of Western Australia. 

Areas of Practice

Preparing, reviewing, advising on, interpreting and negotiating:

  • Commercial and retail lease agreements, including compliance with all legislative approval processes, termination/ default and make good arrangements and the provisions of the Commercial Tenancy (Retail Shops) Agreement Act 1985.
  • A variety of property matters, including property acquisitions and sales, due diligence enquiries and reports, land exchanges, management agreements, contaminated sites, adverse possession, access agreements, easements, restrictive covenants, caveats, subdivisions, profit a prendres and contracts generally.
  • General commercial contracts and arrangements, including trust deeds, franchise agreements, license agreements, supply contracts, shareholder agreements, joint ventures, partnerships, agency, memorandums of understanding, deeds of company arrangement, company constitutions, share acquisitions and sales, share buy backs, asset and equipment acquisitions and sales.
  • Advice on Business structures, directors duties and corporate governance.
  • Banking and financial matters, including loan agreements, inter-creditor arrangements, mortgages, guarantees, both general and specific security agreements and advice on the Personal Property Securities Act 2012.  
  • Advising on and interpreting various legislative instruments, including (in addition to those mentioned above) the Land Administration Act 1997, Property Law Act 1969, Transfer of Land Act 1893 and Duties Act 2008.
  • Assisting with the preparation of certain precedent documents pursuant to the Personal Property Securities Act 2012
