Damon King Damon's experience includes advising government agencies, blue-chip insurers and large employers, particularly in the manufacturing and mining industries, on industrial and employment law matters.

Damon advises clients on the full range of legal issues associated with industrial and employment law, including contracts of employment and contractor agreements, termination of employment, redundancy and unfair dismissal, enterprise bargaining and Greenfields agreements, workplace discrimination and harassment, managing injured and ill employees, and workplace health and safety.

Damon has extensive experience conducting litigation and using alternative dispute resolution, including conciliation and mediation, to cost-effectively resolve disputes. He advises corporate clients in a variety of sectors, with a strong focus on advising professional services providers and employers in the retail, hospitality, manufacturing, energy and resources industries.

Damon holds a Master of Labour Relations Law, a Bachelor of Laws, and is a member of the Australian Human Resources Institute and Industrial Relations Society of Queensland.

Areas of Practice

  • Advising a listed development and construction company on a proposed Greenfields enterprise agreement with the Australian Workers Union.
  • Advising a variety of large employers, such as the Brisbane Lions AFC, on employment agreements and modern award compliance.
  • Advising listed companies, such as Brisbane Markets, Collection House, Chinalco Yunnan Copper Resources and Cabcharge Australia, on a range of employment matters relating to former, departing and new employees, including regulatory constraints on making executive termination payments.
  • Acting as a panel solicitor for self-insured employers, including Xstrata Coal and Arnott’s, in work-related serious injury claims.
  • Advising on redundancy and transfer of employment issues for corporate restructurings and mergers and acquisitions.
  • Advising employers on Fair Work Ombudsman complaints related to unpaid wage and entitlements claims.
  • Advising on independent contractor agreements, including risks in respect of superannuation, workers' compensation and sham contracting liabilities.
  • Conducting litigation in disputes related to alleged breach of employment contracts, including the enforcement of post-employment restraint and confidentiality obligations.
  • Advising on applications for exemptions under anti-discrimination legislation, such as for single-sex accommodation and aged living facilities for caravan and manufactured home park operators.
  • Advising on workers' compensation reviews and appeals, and making submissions to Q-Comp on behalf of employers and self-insurers in defence of reasonable management action.
