James is well regarded as a trusted advisor specialising in the areas of planning and development approvals, planning litigation and dispute resolution, infrastructure, land valuation and the compulsory acquisition of land. 

James has over 20 years’ experience advising developers, local government and State government authorities on all aspects of planning and environment law.  James provides front end advisory services, assisting in strategically framing the approvals processes, through to representing both public and private sector entities in planning litigation in both the Planning and Environment Court and Court of Appeal. He also has extensive experience in negotiating infrastructure agreements.

In addition to litigious planning matters, James is well known for his strategic approach to land resumption, acting for both resuming authorities and landowners in compensation negotiations and Land Court litigation.

James is the Immediate Past President of the Queensland Environmental Law Association (QELA), and is a member of the  Planning Committee for the Property Council of Australia.

  • Acting for an international supermarket chain in relation to the planning and development issues associated with the rollout of its stores in Queensland, including initial site assessment, the development application process and subsequent litigation.
  • Acting for the Department of Transport and Main Roads in a range of Planning and Environment Court matters, including both appeals and declaratory matters.
  • Advising RTA Weipa Pty Ltd trading as the Weipa Town Authority and acting on its behalf in a number of appeals in the Planning and Environment Court.
  • Acting for Karalee Development Partners Pty Ltd in appeals in the Planning and Environment Court concerning its proposal for a large residential subdivision at Karalee.
  • Acted for a major quarry owner in relation to an application for a quarry near Nerang, including proceedings in both the Planning and Environment Court and the Court of Appeal.
  • Acting for the Parmac Property Group in relation to its development of two shopping centres at Hervey Bay.
  • Acting for Lewani Springs Resort Pty Ltd in successfully opposing the development of a shopping centre at Upper Coomera.
  • Acting for the Sunland Group in relation to the development of its shopping centre at Bushland Beach, including proceedings in both the Planning and Environment Court and the Court of Appeal.
  • Acting for landowners in various compulsory land acquisition matters for Queensland infrastructure projects including the Airport Link project, the Southern Freight Rail Corridor, the Northern Busway project, the Gateway Motorway upgrade and the Legacy Way Tunnel Project, including Land Court litigation and dispute resolution.
  • Advising the Department of Transport and Main Roads in relation to the resumption of properties and the assessment of compensation under the Mineral Resources Act 1989 and acting on behalf of the Department in proceedings in the Land Court.
  • Acting for the Seymour Group in respect of the resumption of the old Milton Tennis Court site by the Brisbane City Council.
  • Advising BP Australia in relation to the resumption of land by the Brisbane City Council for the Airport Link Project.
  • Advising the Coordinator-General in respect of the resumption of land for the Gold Coast Showgrounds.
  • Advising on the planning and environmental issues associated with the construction of a gas-fired power station and the development of an LNG processing plant at Gladstone.
