Andrew advises on commercial and corporate litigation and dispute resolution in the areas of insolvency and general contractual related proceedings.  He has experience appearing in the Supreme, District and Magistrates Courts of Western Australia, the Federal Court of Australia, and has been involved in alternative dispute resolution procedures.

Andrew also has experience acting on behalf of clients in construction matters and disputes pursuant to the Corporations Act 2001 (Cth). Andrew holds qualifications in Arts from Monash University a Juris Doctor from Murdoch University and a Postgraduate Certificate in Chinese Law from City University of Hong Kong.

Areas of Practice

Insolvency & Restructuring 

  • Acted for a director of a company in relation to the receivership of the company’s asset.
  • Acting on behalf of the former directors of a company in liquidation with respect to the liquidation and the financial restructuring of the client’s business.
  • Assisting in setting aside a statutory demand on behalf of the company, including drafting court documents and preparation for trial. 
  • Assisting with the implementation of a Deed of Company Arrangement and a creditor’s trust.

Commercial Litigation 

  • Acting on behalf of an ASX listed client in relation to a Philippines based dispute.
  • Acting for a quarry owner in defending a claim brought by a subcontractor pursuant to a contract for drill and blast services.
  • Acting and representing clients in matters relating to breaches of directors’ duties and fiduciary duties.
  • Acting and representing clients with respect to the proper interpretation of contracts.
  • Assisting clients in matters relating to construction and disputes under the Construction Contracts Acts 2004 (WA).
  • Conducting legal research, preparing a barrister briefing files, attending client meetings and drafting correspondence.

  • Acted for a national retailer in respect of its claim against the landlord for misleading and deceptive conduct under the Commercial Tenancy (Retail Shops) Agreements Act 1985 (WA).

Corporate Advisory & Governance

  • Acting and representing clients in matters relating to breaches of directors' duties and fiduciary duties.
  • Assisting in conducting due diligence investigations.
  • Conducting due diligence for a Chinese SOE's proposed placement in an ASX listed company.
  • Assisting with advice to director's on all aspects of liability for both proprietary companies and listed companies.
