Family Assets Pty Ltd v Gold Coast City Council & Anor [2008] QPEC 3

This appeal concerned a deemed refusal by the Gold Coast City Council of an application to approve development of a neighbourhood shopping centre on land at Coomera. The proposal comprised a 3,200m2 supermarket, 800m2 of speciality stores, a childcare centre and a carwash.   The Gold Coast City Council and a submitter, Lewani Springs Resort Pty Ltd both opposed the proposed development.  Hopgood Ganim’s client, Lewani Springs, was in the process of completing construction of its own 6,000m2 neighbourhood shopping centre, anchored by a Woolworths supermarket, on land directly opposite the subject site).

Andrews & Hansen Pty Ltd v Gold Coast City Council [2008] QPEC 4

This appeal concerned the Council’s refusal of an application to reconfigure 32.5 hectares of cleared land on the eastern boundary of the Gilston Valley, west of the Gold Coast, into 25 Park Residential allotments.  The subject land had earlier formed part of a larger parcel, the western portion of which was the subject of an earlier appeal to the Court for rezoning from rural to residential use and which, at the time of the hearing, was in the process of being developed.
