HG Paper: Drafting and Enforcing ADR Clauses - Jul 2006

Alternative dispute resolution (“ADR”) is now common place, in some shape or form, in commercial litigation today. Courts in Queensland, together with many Tribunals, now have the power to coerce litigants to attend and participate in various forms of ADR. It is also becoming more commonplace for consensual ADR clauses to be included in a wide variety of commercial contracts, including construction and franchise agreements.
