Resale Price Maintenance

The Australian Competition and Consumer Commission (ACCC) has recently had success in court actions launched in the Federal Court for resale price maintenance. In each case, the conduct was essentially the same and involved companies trying to prevent their resellers or distributors from selling at discounted prices or below a recommended price.

Ribena's Vitamin C Claims
For many years Ribena's manufacturer, the pharmaceutical company GlaxoSmithKlein has advertised the Ribena fruit drink by claiming that the blackcurrants in the drink contained four times the vitamin C of oranges.However, following action taken against GlaxoSmithKlein by the New Zealand Commerce Commission, the manufacturer approached the ACCC.
