With a sophisticated understanding of property market trends in Queensland and Australia, HopgoodGanim has significant expertise in the legal requirements and legislative boundaries specific to the manufactured homes sector.
Manufactured home parks offer Australia's population an affordable alternative in residential accommodation. HopgoodGanim's team of specialists work together to provide detailed and commercial advice to all stakeholders of the sector, including park owners and managers, land owners and industry representative bodies, on the legal parameters of owning, operating or living at a manufactured home park.
Areas of Expertise
HopgoodGanim has advised the manufactured homes sector for many years. We were responsible for drafting the initial site agreement documentation for the Caravan Parks Association of Queensland and its members when the industry was first the subject of substantial legislation under the Manufactured Homes (Residential Parks) Act 2003, as well as preparing submissions to the Queensland Government on behalf of the Association before that legislation received assent. Since then, we've advised the large majority of the manufactured home park owners and operators in South East Queensland on their legal responsibilities and position in relation to:
- developing manufactured home parks
- buying and selling manufactured home parks
- site agreements, special terms and associated documentation
- agreements for the construction and sale of manufactured homes
- site rent increases
- installation of utility meters and the separate recovery of utility costs
- assignment and termination of site agreements
- permissible park rules
- classification of structures as either 'manufactured homes' or 'caravans' as defined in the legislation
- a park owner's permissible conduct towards home owners
- obtaining exemptions under the Land Tax Act 2010
- the transitional provisions from the previous Mobile Homes Act 1989
