If you operate a business, advertise goods or services, negotiate with suppliers, are a franchisor or distributor, or compete with other businesses, then you are potentially at risk of an unannounced 'raid' by Australia's competition regulator, the Australian Competition and Consumer Commission (ACCC).  

Although these types of investigations have been rare in the past, they are likely to become more prevalent following the recent criminalisation of cartel behaviour and the expanded search and seizure powers the ACCC now enjoys.  

This practical and informative seminar will outline the recent amendments to the Trade Practices Act 1974, which have extended the ACCC's power to enter and search premises when investigating a possible breach of the Act. Special Counsel Brett Bolton, head of HopgoodGanim's Competition and Trade Practices team, will present clear guidelines for you and your employees to follow if the ACCC:

  • presents a search warrant for your business premises, or
  • requests your or your employee's consent to enter and search your business premises.
