Reaching an agreement in a relationship breakdown, rather than going to Court, has its advantages for the couple involved. It allows them to finalise their financial relationship quickly, saving on costs and reducing stress for all involved.

Things aren't always that easy, however, and sometimes a judicial determination will be needed. In this case, you as an advisor may be called on to provide certain information to their lawyers, or to provide evidence and other assistance for Court proceedings.

It's crucial that advisors have an intimate knowledge of the financial arrangements and business structures of their clients. This seminar outlined the main ways that an agreement can be reached and documented after a relationship breakdown, and how advisors can best advise their clients after separation on a number of key issues:
